Privacy Policy

This Privacy Policy specifies the principles of saving and accessing data on the Devices of Users using the Website who are provided with the services by the Controller by electronic means and the principles of collecting and processing personal data of Users which have been provided by them personally and voluntarily through the tools available on the Website.

This Privacy Policy forms an integral part of the Website Terms and Conditions, which specify the terms, rights and obligations of the Users using the Website.

 

§1 Definitions

Website – website “Parametric Warehouse” operating under the address parametricwarehouse.com

External Website – websites of partners, service providers or service recipients cooperating with the Controller

Website Administrator / Data Controller – The Website Administrator and Data Controller (hereinafter: Controller) is “Parametric Warehouse Marian Kuś”, conducting business at: ul. Zakrzewska 6/1 00-737 Warsaw, with the tax identification number (NIP): 9542387299, providing services by electronic means through the Website

User – an individual for whom the Controller provides services by electronic means through the Website.

Device – an electronic device with software, through which the User gains access to the Website

Cookies – text data collected in the form of files placed on the User Device

GDPR – the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation)

Personal Data means information about an identified or identifiable individual (“data subject”); an identifiable individual is one who can be identified, directly or indirectly, in particular by reference to an identifier such as name, identification number, location data, internet identifier or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of an individual

Processing means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;

Restriction of processing means the marking of stored personal data with the aim of limiting their processing in the future

Profiling means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to an individual, in particular to analyse or predict aspects concerning that individual’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements;

Consent – consent of the data subject means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her

Personal data breach means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data transmitted, stored or otherwise processed;

Pseudonymisation means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person

Anonymisation – Anonymisation of data is an irreversible process of data operation which destroys / overwrites “personal data” making it impossible to identify or link a given record with a specific user or individual.

 

§2 Data Protection Officer

On the basis of Article 37 of the GDPR the Controller has not designated the Data Protection Officer.

In the matters relating to the processing of data, including personal data, contact directly the Controller.

 

§3 Types of Cookies Files

Internal Cookies – files placed and read from the User Device by the Website’s ICT system.

External Cookies – files placed and read from the User Device by the External Websites’ ICT systems. The scripts of External Websites that may place Cookies on the User Devices have been deliberately placed on the Website through scripts and services made available and installed on the Website

Session Cookies – files placed and read from the User Device through the Website during one session of a given Device. After the end of the session, the files are deleted from the User Device.

Persistent Cookies – files placed and read from the User Device through the Website until they are deleted manually. Files are not deleted automatically after the end of the Device session unless the User Device configuration is set to delete Cookie files after the end of the Device session.

 

§4 Security of data storage

Cookies Storing/Reading Mechanisms – The mechanisms for storing, reading and exchanging data between the Cookies stored on the User Device and the Website are implemented through the embedded mechanisms of web browsers and do not allow the retrieval of other data from the User Device or data of other websites visited by the User, including personal data or confidential information. It is also virtually impossible to transfer viruses, Trojan horses or other worms to your device.

Internal Cookies – Cookies used by the Controller are safe for User Devices and do not contain scripts, content or information that may threaten the security of personal data or the security of the Device used by the User.

External Cookies – the Controller performs all possible actions to verify and select website partners in the context of User safety. The Controller collaborates only with renown, large partners globally trusted. However, he does not have full control over the content of Cookies coming from external partners. The Controller shall not be liable for the security of Cookies, their content and their licensed use by the Scripts installed on the website, originating from the External Websites, to the extent permitted by law. The list of partners is included in the further part of the Privacy Policy.

Control of Cookies

The User can at any time independently change settings relating to saving, deleting and access to data of saved Cookies by any website in a web browser.

Threats on the part of the User – the Controller applies all possible technical measures to ensure the security of data placed in the Cookies. However, ensuring security of these data depends on both parties, including the User’s business. The Controller shall not be liable for intercepting of these data, impersonating the User’s session or removing it, as a result of the User’s conscious or unconscious activity, viruses, Trojan horses and other spyware which may infect the User Device.

Storage of Personal Data – the Controller warrants that he makes every effort to ensure that the processed personal data entered voluntarily by the Users are secure, access to them is limited and carried out in accordance with their intended purpose and purposes of processing.

Storage of passwords – the Controller declares that the passwords are stored in an encrypted form, using the latest standards and guidelines in this area. Decryption of access passwords provided on the Website is practically impossible.

 

§5 Purposes for which Cookies are used

§6 Purposes of personal data processing

Personal data provided voluntarily by the Users are processed for one of the following purposes:

  • User registration and account maintenance services on the Website and related functionalities
  • Services of commenting / liking entries on the Website without registering
  • Services of sharing information about contents included in the Website in social media or other websites.
  • Communication of the Controller with the Users in the matters related to the Website and data protection

 

The use of the Website requires the processing of the client’s personal data in the scope of: name, telephone number, e-mail and home address. Data will be processed by Parametric Warehouse to the extent necessary for the conclusion and performance of an agreement. Transactional details, including personal data, may be provided to PayLane Sp. z o.o. with its registered office in Gdańsk at ul. Norwida 4, post code: 80-280, KRS: 0000227278 to the extent necessary for handling the payment for an order. The client has the right to access and correct their own personal data. Provision of data is voluntary, but necessary for using the website.

Ensuring the legitimate interests of the Controller

Data about Users are collected anonymously and are automatically processed for one of the following purposes:

  • Keeping statistics
  • Remarketing
  • Ensuring the legitimate interests of the Controller

 

§7 Cookies of External Websites

The Controller uses in the Website javascript and web components of partners who can place their own cookies on the User Device. Please note that in the settings of your browser you can decide about allowed cookies which can be used by given websites. Below you can find the list of partners or their services implemented in the Website, who can place cookies:

Services provided by third parties are beyond the Controller’s control. These entities can at any time change their terms of services provision, privacy policy, purpose of data processing and manners of using cookies.

The Website collects data on Users. The part of the data is collected automatically and anonymously, and part of the data is personal data provided voluntarily by the Users when subscribing to particular services offered by the Website.

§9 Access to personal data by third parties

As a rule, the only recipient of personal data provided by the Users is the Controller. Data collected as part of the services provided are not transferred or sold to third parties.

Access to data (most often on the basis of a personal data processing outsourcing agreement) may be granted to the entities responsible for the maintenance of infrastructure and services necessary to run the website, i.e.:

  • Hosting companies, providing hosting or related services to the Controller
  • Companies intermediating in on-line payments for goods or services offered within the Website (in case of making purchase transactions on the Website)
  • Outsourcing of personal data processing – Hosting Services, VPS or Dedicated Servers Services

 

To run the website, the Controller uses the services of an external provider of hosting, VPS or Dedicated Servers – Kylos Sp. z o. o.

 

§10 Method of personal data processing

Personal data provided voluntarily by the Users:

  • Personal Data will not be provided outside the European Union, unless they have been published as a result of the individual action of the User (e.g. making a comment or post) where data will be available to every person visiting the website.
  • Personal data will not be used for automated decision making (profiling).
  • Personal data will not be sold to third parties.

§11 Legal basis of personal data processing

The Website collects and processes User data on the basis of:

§12 Period of personal data processing

Personal data provided voluntarily by the Users:

As a rule the indicated personal data are stored exclusively for the period of services provision as part of the Website by the Controller. They are deleted or anonymised within 30 days from the end of services provision (e.g. removal of the user registered account, unsubscribing from the Newsletter list, etc.)

The exception is a situation which requires securing legitimate purposes of further processing of these data by the Controller. In such a situation, the Controller will store the indicated data, from the time the User requests their removal, for no longer than 3 years in the case of violation or suspected violation of the website terms and conditions by the User

Anonymous data (without personal data) collected automatically:

Anonymous statistical data, which are not personal data, are stored by the Controller to keep statistics of the website for an indefinite period

 

§13 User rights related to personal data processing

The Website collects and processes User data on the basis of:

Right to access personal data
The Users have a right to be granted access to their personal data, through the user panel available after logging in and tools enabling access to the account in case of a forgotten password.

Right to rectify personal data
The Users have a right to request the Controller to immediately rectify their personal data which are incorrect and/or to complete incomplete personal data through the user panel available after logging in and tools enabling access to the account in case of a forgotten password.

Right to delete personal data
The Users have a right to request the Controller to immediately delete personal data by the request made to the Controller. In the case of user accounts, deletion of data consists in anonymisation of data enabling identification of the User. The Controller reserves the right to withhold the request to remove data to protect legitimate interests of the Controller (e.g. if the User violated the Terms and Conditions or data were obtained as a result of the correspondence conducted).
In the case of Newsletter service, the User has a possibility to delete their personal data independently, using the link included in every e-mail message sent.

Right to restrict the processing of personal data
The Users have the right to restrict the processing of their personal data in the cases indicated in Article 18 of the GDPR, including, among others, questioning the correctness of personal data, upon request made to the Controller.

Right to transfer personal data
The Users have a right to obtain from the Controller personal data relating to the User in the structured, commonly used format for machine reading, upon request made to the Controller

Right to object to the processing of personal data
The Users have the right to object to the processing of their personal data in the cases specified in Article 21 of the GDPR, upon request made to the Controller.

Right to lodge a complaint
The Users have the right to lodge a complaint with the supervisory authority dealing with the protection of personal data.

§15 Website requirements

Restriction of saving and accessing Cookies on the User Device may cause incorrect operation of certain Website functions.

The Controller shall not be liable for incorrect operation of the Website functions if the User restricts in any way the possibility to save and read Cookies.

 

§16 External links

On the Website – in articles, posts, entries or comments of the Users there may be links to external websites with which the Website owner does not cooperate. These links and web pages or files indicated under them may be dangerous for your User Device or pose a threat to your data security. The Controller shall not be liable for the contents outside the Website.

 

§17 Changes to the Privacy Policy

The Controller reserves the right to make any changes to this Privacy Policy without the necessity to inform the Users about this in the scope of use of anonymous data and/or use of Cookies.

The Controller reserves the right to make any changes to this Privacy Policy relating to the Personal Data processing, of which he will inform the Users having user accounts or subscribed to the newsletter, via electronic mail within 7 days of the change of provisions. Further use of the services means that you have read and accept the changes to the Privacy Policy. If the User does not agree with the changes made, s/he is obliged to remove their account from the Website or unsubscribe from the Newsletter.

The changes shall enter into force upon their publication.
